Paperless Billing Terms and Conditions

Vicksburg Water and Gas (VWG) is happy to offer and provide to you Paperless Billing (the "Service"), provided you agree to the following terms and conditions ("Terms and Conditions"). By accepting or otherwise using the Service, you represent that you are the customer of record for the utility account that you are enrolling in or that is enrolled in the Service, or duly authorized to act on behalf of, and with the express consent of, the customer of record; and that you agree to these Terms and Conditions. If you do not agree to comply with these Terms and Conditions, the paperless servcie can not be provided to you.

Service Enrollment Requirements

In order to enroll in the Service, you must be an active Vicksburg Water and Gas utility customer, have an eligible account, and follow the instructions to register your account for the Service. You agree that the information you provide to VWG can go through a verification process. It is your sole responsibility to ensure that your contact information is current and accurate. This includes, but is not limited to, name(s), address(es), phone number(s), e-mail address(es) and account number(s). VWG is not responsible and shall have no liability for any processing errors or fees incurred if you do not provide accurate account or contact information.

Your use of the Service and/or agreement to these Terms and Conditions does not alter your liability or obligations that currently exist between you and Vicksburg Water and Gas concerning your utility usage or other utility-related service. You are responsible for any and all telephone access fees and/or Internet service fees that may be assessed by your telephone and/or Internet service provider.

None of the provisions in these Terms and Conditions supersedes, modifies or in any way mitigates your obligation to be bound by and comply with all applicable tariffs, rules or regulations related to your utility service.

Use of Electronic Communication

By accepting or otherwise using the Service, you agree that any and all notices, disclosures and communications regarding the Service between you and VWG, including these Terms and Conditions, may be made electronically, including by VWG posting to its website in accordance with applicable law. Any electronic notice, disclosure or communication VWG makes will be considered made when transmitted by VWG.

Notification of Bills

You understand that, upon activation of the Service, you will no longer receive VWG paper bills through the mail. Instead, VWG will use commercially reasonable efforts to send you an electronic bill to the e-mail address listed on your account. In the event you do not receive notification, it is your responsibility to contact VWG and make sure your account balance is paid in full.

Payment of Bills

Notwithstanding any notification failure, it is your sole responsibility to pay your Vicksburg Water and Gas bills on time to avoid late fees, collection activity or disconnection of utility service. Applicable late payment fees may apply.

Termination or Cancellation of Service

You may un-enroll from the Service at any time by calling VWG Customer Service at (601) 636-3414. After you un-enroll, any future bills will be mailed to your current address on file with VWG.

If e-mails are returned as undeliverable, VWG reserves the right to un-enroll you in the Service, and return to sending you a paper bill. You may re-enroll at any time after correcting any e-mail address error. VWG reserves the right to cancel the electronic presentment of your bills at any time.

Your obligation to pay your Vicksburg Water and Gas bill by the due date is not altered or modified in any way by any termination or cancellation of the Service.

Errors or Disputes

In case of errors or questions about your utility bill, you should contact VWG Customer Service at (601) 636-3414. In the event of a dispute regarding the Service, you agree to resolve the dispute in accordance with the terms of this Agreement.

Changes to Terms and Conditions

The Service and these Terms and Conditions may be modified or amended by VWG from time to time. In such event, VWG will provide notice to you in accordance with applicable law, which may be accomplished by posting such change on the VWG website. 

Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS", "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY WHATSOEVER.

VWG HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, OR ARISING FROM CUSTOM OR TRADE, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SUITABILITY, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS AND TITLE WITH REGARD TO THE CONTENT AND OPERATION OF THIS SERVICE.

VWG does not warrant that the operation of this Service will be uninterrupted or error free; that defects will be corrected; or that this website or any server used to operate the Service are free from viruses or other harmful components.

In no event shall VWG or the City of Vicksburg Government be liable for any damages in connection with this Service. If you become dissatisfied with the Service, or the terms, conditions or policies governing it, your sole remedy is to discontinue using the Service.

Some jurisdictions do not allow the exclusion of implied warranties, or consequential or incidental damages, so portions of the above exclusions may not apply to you.

The foregoing provisions of this section are for the benefit of Vicksburg Water and Gas, the CIty of Vicksburg, employees, agents, insurers, licensors, and third party licensors and service providers, and each shall have the right to assert and enforce the provisions directly on their own behalf.

Entire Agreement

You acknowledge and agree that these Terms and Conditions set forth are the complete and exclusive statement of the Service to be provided, and these Terms and Conditions supersede any proposal or prior agreement, oral or written, and any other communications between you and VWG relating to the subject matter hereof. These Terms and Conditions may only be modified in writing and may not be modified or altered verbally by any VWG employee.

Governing Law

This Agreement and the terms for the use of the Service shall be governed and construed in accordance with the laws of the State of Mississippi, without giving effect to any principles of conflicts of law. The terms of this Agreement remain in effect until such time that they may be updated.

Electronic Signature

You understand and agree that your click of the "Submit" button to register for the Service constitutes an electronic signature that will be treated in all respects as having the same legal effect as an original handwritten signature; that the information you have provided is true and accurate; that you have read, understand, accept and agree to these Terms and Conditions, that you are duly authorized to bind the customer of record to these Terms and Conditions; and that you authorize (unless and until your account is un-enrolled) VWG to provide the Service for your registered accounts.
